Escrow Account in Dubai Off-Plan: How It Protects Your Payments

How an escrow account for off-plan property in Dubai works, who controls the money, and how to verify a project's escrow account before you pay.

If you are buying off-plan, the escrow account is the single most important safeguard in the transaction. An escrow account for an off-plan project in Dubai is a ring-fenced bank account, held for one project only, into which buyers' instalments must be paid. Understanding how it works, and checking it before you transfer a dirham, is a basic step in any careful purchase.

What an off-plan escrow account is

Dubai developers have been required to open a separate escrow account for each off-plan project since 2007, under Law No. 8 of 2007 on Real Estate Development Escrow Accounts. The account is managed by a licensed bank acting as trustee, and the money in it can be used only to build and complete that specific project. Payments from buyers and from mortgage lenders sit there, not in the developer's general accounts.

The Real Estate Regulatory Agency (RERA), part of the Dubai Land Department (DLD), oversees the system and monitors whether developers follow the rules.

How money is released to the developer

The developer cannot simply withdraw buyer funds when it wishes. Withdrawals are tied to construction progress: the developer submits progress certificates and withdrawal requests, and the trustee bank reconciles what has been received from buyers against what is being paid out to the developer, contractors and consultants. The conditions are set out in the escrow agreement.

  • Buyer instalments are meant to follow actual construction milestones, not just calendar dates.
  • Trustee banks provide periodic statements of income and payments for each account.
  • Annual reports from an accredited auditor check that payments comply with the law and the escrow agreement.
  • Escrow rules also include a retention mechanism for the completion and defects period; the exact terms depend on the escrow agreement, so ask for them.

How to verify an off-plan escrow account before you pay

A DLD official has advised investors to confirm that an off-plan project is licensed and registered with an escrow account, using the Dubai REST app, and to make no payments outside the project's escrow account. In practice, a careful buyer works through this list:

  • Ask the developer for the project's escrow account details, including the trustee bank.
  • Check the project's registration and status in the Dubai REST app, which can show project and escrow information.
  • Ask for the project registration or Oqood reference and verify it with the DLD.
  • Confirm in the sale and purchase agreement that instalments are linked to construction milestones.
  • Pay only into the project's escrow account, never to a personal or company account, and keep every receipt.

What escrow does not cover

Escrow protects how buyer money is held and spent. It does not guarantee a project's quality, its delivery date or its resale value. That is why developer track record, the payment plan and the unit's location still matter. Our guides on choosing an off-plan developer and on how payment plans work cover those questions in more detail.
